1. Agreement to these Terms

These Terms of Use govern your access to and use of OverpayCheck.org and the OverpayCheck service (the “Service”). By using the Service — including starting an OverpayCheck — you agree to these Terms and to our Privacy Policy and Advertiser Disclosure. If you do not agree, please do not use the Service.

2. What OverpayCheck is — and is not

OverpayCheck is an independent comparison platform. We help you understand whether your current recurring costs, starting with auto insurance, may be worth comparing, and we connect you with participating providers you choose to visit.

OverpayCheck is not an insurance company, carrier, broker, or licensed insurance agency. We do not issue policies, provide quotes, set prices, underwrite risk, or give insurance, legal, or financial advice. Your rate and eligibility are always determined by the provider you choose.

3. Your results

A Savings Opportunity result reflects only the information you provide, evaluated against general shopping-signal criteria. It is not a quote, a price prediction, a guarantee of savings, or advice. Providers shown as matches are participating partners that meet basic eligibility criteria for your area; a match is not a recommendation that a provider is the best option for you.

4. Eligibility and your information

The Service is intended for individuals 18 or older located in the United States. You agree that the information you submit during a check is accurate to the best of your knowledge and that you will only submit information about yourself or someone who has authorized you to act for them.

5. How we make money

We may receive compensation from certain partners when you interact with offers on the Service. Compensation may influence which offers appear and their placement. We do not display every provider available in the market. See our Advertiser Disclosure.

6. Third-party providers and websites

When you continue to a provider, you leave OverpayCheck. Your relationship with that provider — including any quote, purchase, or policy — is solely between you and them, under their terms and privacy practices. We are not responsible for third-party content, products, pricing, or conduct.

7. Acceptable use

You agree not to:

• submit false information or impersonate any person;
• use automated means to access, scrape, or overload the Service;
• interfere with the Service’s security or operation, or attempt to access data that is not yours;
• use the Service for any unlawful purpose.

8. Intellectual property

The Service, including the OverpayCheck name, logo, design, and content, is owned by OverpayCheck or its licensors and protected by applicable law. Third-party names and logos that appear on the Service belong to their respective owners and are used for identification only; their appearance does not imply endorsement or affiliation unless expressly stated. We grant you a limited, revocable, non-exclusive license to use the Service for personal, non-commercial purposes.

9. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any particular savings will be achieved.

10. Limitation of liability

To the fullest extent permitted by law, OverpayCheck and its officers, employees, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your dealings with a third-party provider. Our total liability for any claim relating to the Service will not exceed one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

11. Indemnification

You agree to indemnify and hold OverpayCheck harmless from claims arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right.

12. Changes to the Service or these Terms

We may modify or discontinue the Service at any time. We may update these Terms; the “Last updated” date above reflects the current version, and continued use of the Service after changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the United States and the state in which OverpayCheck’s operating entity is organized [state to be confirmed at entity formation], without regard to conflict-of-law rules.
